Медиапространство и суд присяжных в современном мире: риски и пути их нейтрализации

Аннотация
В статье на основе зарубежных научных источников исследуются формы влияния медиапространства на производство в суде присяжных: формирование специфичной модели поведения и подхода к оценке доказательств у присяжных; получение ими информации о деле, не включенной в судебный процесс; предоставление удобного ресурса для запрещенной коммуникации между присяжными и участниками процесса или иными лицами. Существование подобных рисков минимизируется принятием уже апробированных в ряде государств комплексных мер, среди которых как регулирование деятельности СМИ и введение ответственности за размещение материалов, наносящих ущерб справедливости судебного разбирательства, и за поиск этой информации присяжными, так и совершенствование гарантий, предоставляемых уголовно-процессуальным законодательством. К последним методам относятся: оптимизация процедуры отбора кандидатов в присяжные, повышение качества инструкций председательствующего судьи, повышение познавательной доступности процесса и создание оптимальных условий для вынесения правосудного вердикта, основанного на доказательствах (передача дополнительных материалов в совещательную комнату), ограничение доступа к сети Интернет.
