Роль Южноафриканской комиссии по правам человека в реализации социально-экономических прав

Аннотация
Южная Африка известна своим недемократическим прошлым, охватывающим столетия колониализма и десятилетия режима апартеида. Принятие Конституции ЮАР в 1996 г. завершило переход государства к конституционной демократии и заложило основы нового южноафриканского государства и общества.
Исправление исторического неравенства лежит в основе Конституции ЮАР 1996 г., а включение в Билль о правах социально-экономических прав, подлежащих судебной защите, во всем мире считалось прогрессивным и отличительным. Кроме того, включение этих прав продемонстрировало, что они также имеют основополагающее значение для восстановления государства и искоренения неравенства, характерного для эпохи апартеида.
Центральное место в эффективной реализации ряда прав, гарантированных Конституцией ЮАР, занимает ряд государственных институтов, созданных с целью укрепления конституционной демократии. В данной статье проводится анализ основных направлений деятельности и оценивается роль Южноафриканской комиссии по правам человека в реализации социально-экономических прав в стране.
