Не учтено то обстоятельство, что насильственное посягательство против личности не может быть административным проступком. Не учтено и то, что разумное наказание ребенка родителем не может рассматриваться в качестве побоев. Реформа рождает правовую неопределенность, в частности, по вопросу о возможности необходимой обороны от побоев. Сравнение норм российского и английского права приводит к выводу, что российский законодатель относится к насилию гораздо более терпимо, причем имеют место противоположные тенденции в развитии российского и английского права в этом аспекте.</p></abstract><trans-abstract xml:lang="en"><p>Partial decriminalization of battery in Russia does not allow achieving the desired goals. The fact that a violence cannot be regarded as an administrative offense is not taken into account. The reasonable punishment of the child by the parent should not be seen as punishable battery. The reform has increased legal uncertainty. It cast doubt on the right to self-defense against common assaults.
