С 1974 г. особую популярность приобрела метафора legal transplant, при этом специалистами в области компаративистики предлагается ряд альтернативных терминов для концептуализации данного феномена. В статье анализируются метафоры, акцентирующие внимание на результате, который наступает после заимствования правовых концептов, и на том, какие необходимо предпринять меры для того, чтобы «пересадка» была успешной. Подчеркивается, что, с одной стороны, именно метафора является тем инструментом, который позволяет уловить тонкости и сложности феномена заимствований в праве, с другой - с ее помощью не всегда удается стереть концептуальные сложности и в некоторых случаях ей не следует придавать особое значение.</p></abstract><trans-abstract xml:lang="en"><p>In comparative law, the many terms and metaphors used to describe the phenomenon of legal borrowings. Since 1974, the legal transplant has become the dominant metaphor, while specialists in the comparative law offer a number of alternatives to conceptualise the legal transplantation phenomena. The Article focuses on metaphors that take into account the the post transfer effect on the recipient legal system and what measures have to be taken to ensure that the legal transplant is successful. on the one hand, a metaphor is instrument which help to catch subtleties and the complexity of the legal transplantation phenomena. On the other hand, a metaphor do not always help to erase the conceptual issues.
