В статье показаны проблемы, связанные с проведением государственной кадастровой оценки земель и определением размера кадастровой стоимости земельных участков, которая применяется при расчете земельного налога, арендной платы, выкупной стоимости земельного участка в случае его выкупа из состава земель, находящихся в государственной или муниципальной собственности. По данной категории дел формируется противоречивая судебная практика. В условиях изменения законодательства в области государственной кадастровой оценки обоснована необходимость учета особенностей земельных участков из состава земель различных категорий при их оценке и определении размера стоимости земельных участков. Это будет способствовать обеспечению земельных прав граждан и юридических лиц, в том числе при разрешении споров в судебном и внесудебном порядке.
Review. The article shown the problems associated with carrying out the state cadastral assessment of lands and determination of the size of the cadastral value of land, which is used in the calculation of land tax, rent, purchase price of the land plot in case of its redemption from the lands being in state or municipal ownership. In this category of cases is formed a contradictory judicial practice. In the context of changing legislation in the field of state cadastral assessment of the necessity of considering the peculiarities of land plots from structure of lands of different categories for their evaluation and determining the value of land. This will help to ensure land rights of citizens and legal persons, including in the resolution of disputes in judicial and extrajudicial.
