На основе сравнительно-правового анализа выявлены две доминирующие модели: квазизападная и фундаменталистская, различающиеся по правовому значению шариата, степени секуляризации торгового законодательства и подходам к построению системы торговых договоров. В рамках квазизападной модели (на примере ОАЭ) прослеживается дифференциация правового режима торговых договоров на светский и исламский, тогда как фундаменталистская модель (свойственная, например, Саудовской Аравии) характеризуется прямым действием шариата и единым религиозно-правовым режимом торговых договоров. Выявлено, что общей тенденцией для обеих моделей является кодификация торгового законодательства, однако с различными целями: в странах с квазизападной моделью кодификация направлена на секуляризацию торгового регулирования с выделением специального религиозно-правового режима, в странах с фундаменталистской моделью — на систематизацию религиозно-правового регулирования торговой деятельности.</p></abstract><trans-abstract xml:lang="en"><p>The article examines the main models of legal regulation of trade (commercial) contracts in modern Muslim countries. Based on comparative legal analysis, two dominant models have been identified: quasi Western and fundamentalist, differing in the legal significance of Sharia, the degree of secularization of trade legislation, and approaches to structuring the system of trade contracts. Within the quasi Western model (using UAE as an example), there is a differentiation of the legal regime of trade contracts into secular and Islamic, while the fundamentalist model (characteristic, for example, of Saudi Arabia) is characterized by the direct application of Sharia and a unified religious-legal regime for trade contracts.
