При этом положения права ЕС об ответственности перед участниками закупки менее детальны и конкретны, чем иные направления регулирования данной сферы. Некоторые уточнения можно найти в практике Суда ЕС. Прецедентное право ЕС устанавливает правовые тесты, позволяющие оценить возможность привлечения государства к ответственности за нарушение положений актов Союза, в том числе за нарушение законодательства о закупках, а также формулирует ряд общих требований, предъявляемых к национальному законодательству в части взыскания убытков, причиненных нарушением прав участников закупок. В частности, не допускается ставить возможность взыскания убытков в зависимость от наличия в действиях заказчика вины, необходимо наделение участника закупки правом на возможность возмещения не только реальных убытков, но также потерь дохода и процентов и др. Тем не менее право Союза ограничивается лишь вопросами установления оснований ответственности, но не регулирует процессуальные аспекты, применимые к заявлениям участников о возмещении убытков, которые подлежат регулированию на национальном уровне.</p></abstract><trans-abstract xml:lang="en"><p>European Union law has largely harmonized the legislation of the Member States on public procurement. At the same time, the provisions of the EU law on liability to procurement participants are less detailed and specific than other provisions of EU procurement law. Some clarifications can be found in the Court of justice’s jurisprudence. EU case law establishes legal tests to assess the possibility of finding the member state accountable for violation of the provisions of Union legal acts, including for violation of procurement legislation, and also formulates a number of general requirements for national legislation in terms of recovery of losses caused by violation of the rights of procurement participants.
